The governing documents of BAS (e.g., Declaration of Condominium, Bylaws, Board Resolutions, Rules and Regulations) are in the hands of each owner and may also be made available to prospective buyers (at a nominal fee) by the BAS Board of Directors.  Pertinent and important points include: (1) the requirement that at least one residing owner be of age 55+; and (2) that no person under age 18 may reside on the premises for a period of time exceeding an aggregate total of 30 days in any twelve-month period. These age and occupancy restrictions are enforced and verified by census to ensure that BAS retains its status as a 55+ Active Adult Community under the guidelines set forth under the Federal government’s Fair Housing Amendments Act of 1988.

Furthermore, in order to preserve and protect the nature of BAS as a primarily owner-occupied community, the Declaration specifies that a minimum of 90% of the units must be occupied at all times by registered and legal owner(s).  The leasing of units is therefore capped at an absolute 10% and any owner desiring to lease its unit must apply for and receive an approved leasing permit.  If that leasing cap of 10% should have been met (as it has been presently), an owner may be placed, if he desires, on a permit waiting list.  Only when an existing owner/lessor relinquishes his permit, by either moving back into the unit or selling the unit, may the first owner on the waiting list be allowed to lease.
